Beset pioneer of the Indigenous People of Biafra, (IPOB) Mr. Nnamdi Kanu, who is confronting a six-check injustice charge, has contradicted an application by the government to direct his trial in mystery.
FG had in the application it documented in the witness of the Federal High Court sitting in Abuja, discredited that every one of the witnesses charged to affirm against Kanu and two other genius Biafra fomenters, Benjamin Madubugwu and David Nwawuisi, who are confronting trial with him, have declined to show up in court.
Chief of Radio Biafra, Nnamdi Kanu, sandwiched between security operaives, leaving the court yesterday in Abuja. It said the witnesses demanded that they would not affirm against the respondents unless their security was ensured.
Thus, government attorney, Mr. David Kaswe, begged trial Justice John Tsoho to issue a request allowing so as to ensure the characters of the witnesses them to either wear facial veil or to affirm behind screens. FG similarly connected for a request barring persons with the exception of writers from seeing the procedures.
"The measure is to protect the lives of arraignment witnesses who live in the land locale where the litigants originate from. Following their capture, there has been rough challenges for the respondents to be discharged. "The witnesses have as of now demonstrated apprehension to give proof in perspective of saw backfire.
My ruler, they have completely educated us that unless they could be ensured some type of security by the court, they would not come to affirm.
"In the light is this, the instance of the indictment will be enormously influenced ought to there be any explanation behind the witnesses not to come to court", Kaswe submitted.
In the interim, Kanu, through his lead counsel, Chief Chuks Muoma, SAN, passionately contradicted the application which he said terribly needed legitimacy.
He contended that segment 36(4) of the 1999 constitution made no procurement for masquerades to affirm in a trial involving an asserted demonstration of conspiracy.
"A blamed individual under our statute and equity administration must be gone up against with his informers eye-ball to eye-ball.
"My ruler we work an accusatorial arrangement of system under the normal law. Equity must be done as well as must be seen to have been finished.
"It is not inside of sound judgment to censure and charge somebody in broad daylight and apply to attempt him in the room. Having been blamed in broad daylight we need to likewise be attempted openly. "We subsequently ask this court not to permit masquerades to affirm before it.
We need to see their countenances and make inquiries. As masquerades, by what means will the court have the capacity to gage their manner and non-verbal communication? Is it by the mood of their move steps? "The precepts of equity exceed this application and we encourage my ruler to reject it.
It has no legitimacy at all. Mystery trial is for terrorism charge, it is not for the sort of offense for which these litigants were charged. "Mystery trial does not have any significant bearing for a situation of treasonable lawful offense or association in charged unlawful society.
Amid the trial we will demonstrate to them that we are not an illicit association", Muoma included. In the wake of listening to the gatherings, Justice Tsoho remained down decision on the matter till 2pm.
Kanu who was until now the Director of Radio Biafra and Television, has been in detainment since October 14, 2015, when he was captured by security agents upon his entry to Nigeria from his base in the United Kingdom.
The litigants were charged to have carried out treasonable lawful offense, an offense culpable under Section 41(C) of the Criminal Code Act, CAP C38 Laws of the Federation of Nigeria.
FG charged that they were the ones dealing with the undertakings of the IPOB which it depicted as "an unlawful society".
In particular, Kanu was charged to have wrongfully carried radio transmitters into Nigeria, which he used to spread "scorn telecasts", empowering the "severance of the Republic ofBiafra", from Nigeria. Nonetheless, the denounced persons, argued not blameworthy to the charge on January 20, even as the court requested their remand at Kuje jail in Abuja.
